The Mediation Process: What to Expect
Mediation follows a clear, structured process designed to facilitate constructive dialogue and reach a mutually agreed resolution:
Step 1: Initial Consultation & Agreement
- I meet with each party separately to explain the process and discover some background details.
- Rules and disclosure of information between the parties will be agreed before commencement. A mediation agreement will also be signed by everyone involved.
Step 2: Individual Meetings
- On the day of mediation, one-on-one meetings to allow participants to express their perspectives privately.
- Participants outline what they hope to achieve from mediation.
Step 3: Joint Mediation Session
- Both parties then come together for a structured discussion.
- I facilitate the conversation, ensuring equal participation and respect.
- Each party shares their viewpoint, and key issues are identified and discussed with the aim or reaching a mutually acceptable solution that everyone can agree on.
Step 4: Agreement & Resolution
- Once agreement is reached, we will pause while I prepare an agreement for both parties to sign.
- Participants commit to the agreed terms.
- At the end of the mediation all notes are destroyed for confidentiality.
Mediation is highly effective because participants take ownership of the solution, leading to higher success rates.
